Overview

Our firm's mission is to provide the highest quality, cost effective management services your homeowners or condominium association deserves. If you have are a new community, we can set you up with everything you will need, without any headaches. We also specialize in assisting condominium and homeowners' associations that may be in financial or other difficulty as the result of poor service from a prior management company.

At Stepniak & Stepniak our focus is on customer service and financial responsibility. We work for YOU, the board members and homeowners, and provide all of the services necessary for the seamless operation of your association.

Management Services Provided

  • Survey the property completely at least once every two weeks; assign any routine maintenance needed to maintenance staff. Note any larger problems and report (with recommendations) to the Board of Directors. Walk the property once every 4 to 6 weeks to rectify any homeowners' violations, more often if necessary.
  • Provide Monthly or Quarterly Management Reports summarizing maintenance performed, areas where maintenance is needed, and other problems. We will also make appropriate recommendations to the Board of Directors.
  • Obtain, analyze and present to the Board of Directors a minimum of three bids for any major work to be performed. (Including checking contractors' licenses, insurance and references).
  • Ensure that contracts and agreements between the Association and subcontractors are performed in accordance with their terms. (Including making the final walk-through and creating punch lists.)
  • Supervise and assign work to all in-house personnel, including maintenance, grounds keeping, janitorial, pool care, etc.
  • Review and monitor the performance of service contractors, and recommend changes to provide better performance, greater efficiency and/or lower maintenance cost.
  • Attend Board Meetings when requested.
  • Help in preparation of notices of meetings and agendas. We will fax the agenda and meeting notices to on site Board member for posting and assist in organizing meetings.
  • Prepare annual meeting agendas, proxies, ballots and election material as required by law. Assist in organizing meeting, election of officers and calculation of votes.
  • Assist in the first meeting of the Board to elect officers. Ensure a smooth transition by briefing new Board members on policies and procedures.
  • Review the insurance coverage of the Association and make recommendations for modification or additional coverage, if necessary. Obtain and analyze at least three (3) proposals for comparison to present policy prior to renewal.
  • Act as a buffer between the Board and the unit owners and tenants.
  • Enforce Rules and Regulations; establish policies for same if needed.
  • Answer questions, problems and complaints of unit owners and tenants.
  • Provide professional expertise, knowledge of Association Documents and Condominium laws.
  • Regularly check for violations of the Documents, Rules and Regulations, and take enforcement action as directed by the Board of Directors.

The attorneys cover the entire spectrum of legal counseling of condominium, cooperative, time-shares and homeowners associations. In addition, they provide counseling to master and sub-associations. Each attorney acts as part of their client's professional team, assisting the Board and respective management company prepare for and conduct meetings; interpreting association documents and opining legal opinions; enforcing the covenants, conditions and restrictions and; drafting and negotiating amendments and contracts.

Among the types of services routinely provided to Community Association clients are the following:

  • Legal counsel in the application of state and local law and court rulings and administrative decisions impacting on the operation of Community Associations.
  • Compliance with applicable Federal laws, such as the Telecommunications Act of 1996, the Fair Housing laws, and the Employment Discrimination Laws, as well as similar state and local statutes and ordinances.
  • Interpretation, amendment and enforcement of the governing documents -- Declaration of Condominium, Declaration of Covenants, Conditions and Restrictions, the Articles of Incorporation, the Bylaws of the Association and the rules and regulations.
  • Answering day-to-day questions regarding operational, technical, regulatory, and practical issues.
  • Advising on Hurricane preparation, protection and counsel on recovery and rebuilding efforts.
  • Assisting the Board of Directors on fiscal matters, such as budgeting, levying special assessments, and establishing reserves.
  • Addressing maintenance and repair issues and distinguishing between those projects which require Board approval, and those, which require unit owner approval.
  • Drafting and reviewing contracts for the management, maintenance, repair and operation of the community.
  • Assisting in planning and developing contracts for construction projects and complying with construction lien laws.
  • Collection of delinquent assessments.
  • Providing legal counsel for post-transition, unit owner-controlled Association on developer issues, including the resolution of warranty, accounting and representation claims, and the establishment of on-going operational controls.
  • Reviewing loan documents and structuring commercial lines of credit and/or arranging sources of financing for recreation lease purchases, capital improvements, etc.
  • Poliakoff hurricane recovery site, and governmental agencies such as FEMA;
  • Categorizes the legislative bills based on subject matter and the type of common interest ownership community;
  • Provides press coverage from around the State concerning common interest ownership issues and much more.
