Common Mistakes to Avoid When Getting Divorced

Posted By Stepniak & Park || 2-Apr-2018

Divorce is often one of the most emotionally overwhelming processes of people’s lives, whether or not they have the legal assistance of a divorce lawyer. From dividing property and assets to potentially losing the custody of your children, the divorce process can bring up a lot of intense emotions and cause people to make several mistakes which may have a negative impact on the final outcome of the case, as well as on the future.

The following are several of the more common divorce mistakes to watch out for:

  • Letting your emotions get the best of you. Stress, anger, despair, and a plethora of other intense emotions can be experienced during the divorce process. A person’s judgment may be clouded by intense emotions that may cause them to fight for things he or she doesn’t necessarily want/need or result in a more lengthy and costly divorce process. In order to reach an amicable agreement with your soon-to-be-ex-spouse, it is imperative to do whatever it takes to keep your emotions in check and away from negotiations.
  • Lying about your financial situation or attempting to hide marital assets. Finances play a significant role in divorce. If you want your divorce to end as smoothly as possible, it is imperative that both parties are honest and produce accurate information, including the amount of marital debt and assets you have. Hiding or failing to disclose your marital assets can result in you losing important ground in your divorce case, compromise any agreements that have already been made, or lead to criminal charges.
  • Involving your children. Keep your kids away from the details of divorce and emotions you feel about your spouse. Telling them too much information can cause undue stress. Attempting to make them hate the other parent can result in substantial damage the can have long-lasting effects. However, you should always put your children’s needs and best interests first.
  • Refusing to compromise. Some couples going through divorce are so stubborn that they won’t give in to negotiations, which only results in further conflict and added stress. In order to reach an agreement that both parties can be comfortable with, they must both be willing to compromise.
  • Abusing social media. When you put something on Facebook or Instagram, it could ultimately be used against you in court. Something as innocent as going on a luxurious vacation or drinking with your friends could harm your case. However, do not deactivate your account entirely, just avoid posting as much as possible until the divorce is finalized.
  • Moving out of the family home. As soon as a couple decides to separte, it is ofetn the male who volunteers to leave the home. However, moving out can result in more costs since you are paying rent for another place while supporting the other household. Although it may not be easy to live with someone you’re divorcing, it may be the best decision to hold your ground.
