Sexual Offenders vs. Sexual Predators

Sex offender registration and sentencing laws in Florida are one on of the harshest in the country. According to state law, there are two types of sex crime designations: sexual offenders and sexual predators.

A sexual offender is an individual who must have been convicted of a qualifying offense in Florida or in another jurisdiction. Or, someone who has been released from or is currently serving incarceration, probation, or parole on or after October 1, 1997.

In total there are 23 offenses that qualify for the sex offender designation, which include some of the following:

  • Sexual misconduct
  • Kidnapping of a minor
  • False imprisonment of a minor
  • Luring or enticing a child
  • Unlawful sexual activity with certain minors
  • Child pornography

On the other hand, a sexual predator are those convicted of first-degree felony sex crimes or two second-degree felony sex offenses over a period of ten years. This means that if an individual engages in violent behaviors or commits the most serious types of crimes regarding sexual conduct, he/she could be classified as a sexual predator.

Any person required to register with local police as a sex offender must comply with strict rules and restrictions. However, sexual predators often find that their reporting requirements are more harsh and rigorous.

Both sexual offenders and sexual predators must maintain registration for the rest of their life. However, after 25 years without arrest, sex offenders can as the court to remove them from the registry.

If a registered sexual offender or sexual predator when required to, or if they fail to update their driver’s license number within 48 hours of moving, or if they fail to comply with any other requirements, they could be charged with a felony.
