Is Divorce Mediation Right for You?

Divorce can be a long and expensive process, especially if one or more issues (i.e. alimony, child custody, property division, etc.) are hotly contested. However, couples who are willing to end their marriage on amicable and respectful terms can reach an agreement through divorce mediation.

Mediation is an alternative way to resolve divorce disputes that is facilitated by a third-party mediator who helps foster communication, work through the issues, and help couples negotiate the terms of their own divorce settlement. The ideal mediator must have extensive training, knowledge, and experience in family law.

The following the common benefits of divorce mediation:

  • Less costly - When a divorce case ends up going to trial, couples will incur both attorney and court fees. Additionally, preparation for trial and assistance from expert witnesses can significantly increase costs. In contrast, mediation is the cheaper option because couples avoid the costs of trial.
  • Quicker results - Divorce through court litigation can take months or even years to resolve, mainly because couples are at the whim of the court schedule. On the other hand, divorce mediation can be completed within several weeks. Couples have the ability to set their own timeframe to negotiate a settlement.
  • Control of the outcome - Rather than having a judge decide who gets the family house or primary custody of the children, couples determine which issues to discuss and resolve. They have final say over the divorce agreement. Those who are able to negotiate their own settlements typically feel more empowered because there are no winners and losers in mediation.
  • Good for the children - It is important for both parents to cooperate and be respectful toward each other for the best interests of the kids. If parents can work together during divorce, it ensures they can successfully co-parent their children in the future.

If a divorce involves one spouse hiding assets or inflicting domestic violence, then it is recommended to seek a resolution through mediation. However, the initial stages of divorce may involve meeting with a mediator to see if mediation is right for you.
